Welcome to Flexaro. The following document outlines the terms and conditions of using our services. By using our website, services, or purchasing a product from us, you agree to comply with these terms. Please review the following carefully.
This document is governed by the laws of the Democratic Socialist Republic of Sri Lanka.
Definitions
- “Flexaro”, “we”, “us”, and “our” refer to the owners of Flexaro, the service provider.
- “User” and “Client” refer to individuals or entities using Flexaro's services.
- “Service” refers to the services we offer, as outlined below.
- “Product” refers to the results or deliverables generated as part of a service, or products sold by Flexaro.
- “Contract Agreement” and “Client-Developer Agreement” refer to the agreement specified in Section 3.
1. Users/Clients
A user is any person or entity that engages with our services. By purchasing our services or entering into a contract, the user agrees to these Terms of Service and is registered in our database according to our privacy policy.
Users must ensure that they are of legal age to enter into a contract and provide the required personal information.
2. Services
Flexaro provides the following services:
- Web Design, Web Development, and Web Application Development.
- Desktop and Mobile Application Development.
- Content Writing, SEO, and Graphic Design.
- Any other service described in products & services page.
2.1 Maintenance Services
We also provide additional maintenance services for websites, software, and other products we develop. Terms for these services will be outlined in the contract agreement.
2.2 Service Process
To receive our services:
- Clients must provide the necessary details, including personal information, through email, WhatsApp, or our website.
- We will review the request, contact the client, and if necessary, request additional information.
- Upon mutual agreement, we will provide a service plan and price.
- f the client agrees to proceed, they must sign the Client-Developer Agreement and make an initial payment.
- Development or service delivery will then begin.
After the project is completed, the client may receive the product or continue using the services on our servers, depending on the agreement.
3. Contract Agreement
The Client-Developer Agreement contains specific terms for the service(s) requested by the client. Clients must thoroughly review and understand the contract before signing. This agreement is considered valid once the initial payment is received.
Clients can sign the contract electronically or physically and submit it to us via email or mail.
If a client wishes to negotiate specific terms, they may discuss them with us, but our decision is final.
4. Initial Payment
The initial payment, which is non-refundable, must be made to start the contract. If no specific amount is stated, it will be 30% of the total price.
Should the client refuse or delay the initial payment, the contract will not be considered valid.
5. Receiving Final Product/Service
After the completion of the service or product:
- The client will review and approve the deliverable.
- The remaining payment (total minus the initial payment) must be made after approval.
- The method of product/service delivery will depend on the contract terms.
6. Payments
The remaining payment is due upon completion of the service, as specified in the contract. If not detailed in the contract, the payment terms will follow the general guidelines outlined here.
7. Cancellation of Contract/Service
Clients may cancel the contract at any time by written notice via letter or email. Flexaro also reserves the right to cancel the service at any point.
In the event of a cancellation, the initial payment is non-refundable.
8. Maintenance and Support
Flexaro offers long-term maintenance and support for websites, applications, and other services. Some projects may come with a free maintenance period, detailed in the contract.
For products hosted on our servers or domains, Flexaro will manage renewals for third-party services like domain registration, API, and SMS services. An 8% processing fee will be added to renewal costs.
We will notify clients of any changes or issues related to these services, including unplanned server downtime.
9. Service Restrictions
As a business operating in Sri Lanka, Flexaro complies with national law and reserves the right to refuse any services that violate legal, ethical, or company policies.
